Terms of Use

1. Introduction and Acceptance

These Terms of Use (the “Terms,” “Agreement”) constitute a legally binding agreement between you (“you,” “Player,” “User”) and Jacked Up Games Ltd (“Company,” “BetMighty,” “we,” “us,” “our”), a company registered at Hamchako, Mutsamudu, Autonomous Island of Anjouan, Union of Comoros, governing your access to and use of the website, mobile applications, software, and related services (collectively, the “Site” or “Service”).

By creating an account, accessing, downloading, installing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Responsible Gambling Policy, our Cookie Policy, and any game-specific or promotion-specific rules referenced within the Service (together, the “Agreement”). If you do not agree to any part of this Agreement, you must immediately cease use of the Service.

This Agreement is available in the language(s) offered on the Site. In the event of any conflict or ambiguity between a translated version and the English-language version, the English version shall prevail, unless prohibited by applicable local law.

2. Definitions

• “Account” means the player account you register to access the Service.
• “Content” means all text, graphics, software, game outcomes, trademarks, and other material available on the Site.
• “Funds” means any money or cryptocurrency deposited into, held in, or withdrawn from your Account.
• “Winnings” means amounts credited to your Account as a result of successful wagers.
• “Bonus” means any promotional credit, free spin, cashback, or other incentive offered by us.
• “Business Partner” means any third-party game provider, payment processor, or affiliate integrated with the Service.

3. Eligibility and Geographic Restrictions

3.1 You must be at least 18 years of age, or the legal age of majority for online real-money gambling in your jurisdiction of residence, whichever is higher.

3.2 You must have full legal capacity to enter into a binding contract under the law applicable to you.

3.3 You represent and warrant that:

• Accessing and using the Service is lawful in your jurisdiction of residence and the jurisdiction from which you are accessing the Service;
• You are acting on your own behalf and not on behalf of any third party;
• The funds you use to deposit are lawfully owned by you and not derived from criminal activity.

3.4 It is your sole responsibility to determine whether online real-money gambling is legal where you live. We make no representation that the Service is appropriate or lawful for use in any particular jurisdiction, and access from jurisdictions where such use is prohibited is at your own risk.

3.5 We reserve the right to restrict, block, or refuse access to the Service from any country, region, or IP address at our sole discretion, with or without prior notice, including to comply with licensing conditions, sanctions regimes, or export-control requirements.

3.6 Directors, officers, employees, and immediate family members of Jacked Up Games Ltd, its affiliates, licensors, and any party involved in the development, operation, or distribution of the Service are prohibited from holding an Account or participating in any promotion.

4. Account Registration and Verification

4.1 One Account Per Person. You may register and hold only one Account. Operating multiple Accounts (including via different names, emails, devices, IP addresses, or households) may result in suspension of all associated Accounts and forfeiture of Funds and Winnings held in the duplicate Accounts, without prejudice to our other rights.

4.2 Accuracy of Information. You must provide true, accurate, current, and complete information during registration and promptly update your Account if any information changes.

4.3 Security. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your Account, whether or not authorized by you. Notify us immediately of any suspected unauthorized use.

4.4 Identity Verification (KYC). As a licensed gaming operator, we are required to verify the identity, age, and, in certain cases, source of funds of our Players. You agree to provide, upon request, valid government-issued identification, proof of address, proof of payment method ownership, and any other documentation reasonably required. We may request this documentation at registration, prior to a withdrawal, or at any other time during the life of your Account. Full details are set out in our KYC Policy.

4.5 Right to Refuse or Suspend. We reserve the right, at our sole discretion, to refuse registration, or to suspend, restrict, or close an Account, where we have reasonable grounds relating to fraud prevention, regulatory compliance, risk management, or breach of this Agreement.

4.6 Dormant Accounts. If your Account remains inactive for an extended period (typically 12 months or as otherwise specified in our Responsible Gambling Policy), we reserve the right to classify it as dormant and may apply a dormancy fee or close the Account, subject to prior notice and applicable law, and subject to returning any remaining Funds to you in accordance with escheatment or unclaimed-funds rules where applicable.

5. Anti-Money Laundering (AML) and Counter-Terrorist Financing (CTF)

5.1 We maintain AML/CTF policies consistent with international standards, including guidance issued by the Financial Action Task Force (FATF), and the requirements of our gaming license.

5.2 We monitor transactions and Account activity for patterns consistent with money laundering, terrorist financing, or fraud, and may request additional documentation regarding the source of funds or source of wealth for any transaction.

5.3 We reserve the right to delay, restrict, or refuse any deposit or withdrawal, freeze an Account, void Winnings, or report activity to relevant financial intelligence units, regulators, or law enforcement agencies where we have reasonable suspicion of illicit activity.

5.4 Failure to provide requested verification or source-of-funds documentation within a reasonable period may result in suspension of your Account and withholding of Funds pending resolution.

6. Deposits, Withdrawals, and Currency

6.1 All deposits must be made using payment methods offered by the Casino and must belong to and be used only by you.

6.2 We reserve the right to set minimum and maximum deposit and withdrawal limits, which may vary by payment method, currency, or jurisdiction, and to update these limits from time to time.

6.3 Withdrawals will, wherever reasonably possible, be processed back to the same payment method used for the corresponding deposit, in order to comply with AML requirements, and are subject to successful completion of identity verification.

6.4 We reserve the right to decline, delay, or reverse a withdrawal request pending verification, fraud review, chargeback investigation, or resolution of a dispute.

6.5 Any transaction, credit, or Winnings recorded due to a technical malfunction, software error, pricing error, or human error may be corrected, adjusted, or reversed by us at any time, even after the funds have been withdrawn, and you agree to cooperate with the return of any such erroneous amounts.

6.6 Where transactions involve currency conversion or cryptocurrency, exchange rates and network/processing fees applicable at the time of the transaction will apply, and we are not responsible for market fluctuations affecting the value of cryptocurrency Funds.

6.7 You are solely responsible for determining and paying any taxes applicable to your Winnings under the law of your jurisdiction of residence. We do not provide tax advice and may, where legally required, report Winnings to tax authorities.

6.8 Chargebacks. Initiating a chargeback or payment reversal without first contacting our customer support to resolve a dispute may result in suspension of your Account, forfeiture of associated Winnings, and recovery action for any resulting losses, fees, or costs incurred by us.

7. Bonuses and Promotions

7.1 Bonuses, free spins, cashback, and other promotional offers are subject to specific terms (including wagering requirements, eligible games, expiry periods, and maximum withdrawal caps) published alongside each offer, which form an integral part of this Agreement.

7.2 We reserve the right to modify, suspend, or withdraw any Bonus or promotion at any time, and to determine eligibility at our sole discretion, subject to honoring commitments already properly earned under the applicable promotional terms in effect at the time.

7.3 Bonus Abuse. The following (non-exhaustive) conduct constitutes bonus abuse and may result in forfeiture of Bonus funds and related Winnings, and suspension or closure of the Account(s) involved:

• Registering or using multiple Accounts to claim the same Bonus more than once;
• Colluding with other players to guarantee or minimize risk of loss while completing wagering requirements;
• Using betting patterns designed to exploit an error in the Bonus terms, game payout structure, or software;
• Withdrawing or attempting to withdraw funds derived from a Bonus before the applicable wagering requirement is met.

7.4 Publicity Consent. By accepting any contest prize, promotional prize, leaderboard reward, or Winnings arising from a promotion, you consent to our use of your name and/or Account nickname for advertising and promotional purposes across our marketing channels, without additional compensation, except where such use is prohibited by applicable law. You may withdraw this consent for future use by contacting customer support, without affecting publicity already conducted.

8. Responsible Gambling

8.1 We are committed to promoting responsible and sustainable gambling. Tools made available through your Account settings may include deposit limits, loss limits, wager limits, session-time reminders, temporary time-outs, and self-exclusion.

8.2 If you believe your gambling may be problematic, we encourage you to use these tools and to seek support from an independent gambling-support or counseling organization available in your jurisdiction.

8.3 Self-exclusion requests, once accepted, are binding for the period selected and cannot be reversed by you before that period expires, except in accordance with our Responsible Gambling Policy. During self-exclusion, we will take reasonable steps to prevent you from opening a new Account, and will suspend marketing communications to you.

8.4 We reserve the right, at our discretion, to impose limits on, suspend, or close an Account where we have reasonable concern about indicators of harmful or problem gambling behavior, even absent a request from you.

8.5 Nothing in this Agreement creates an obligation on our part to identify, diagnose, or intervene in any individual Player’s gambling behavior beyond what is required by applicable law and our license conditions, and use of the Service remains at your own risk and discretion.

9. Game Rules, Fairness, and Random Number Generation

9.1 Each game available on the Site is subject to its own specific rules and paytables, accessible within the game client or its help/information section, which form part of this Agreement. In the event of any conflict between these Terms and specific game rules, the game rules shall prevail in relation to that game only.

9.2 Game outcomes are determined using certified Random Number Generators (RNGs) or, for live dealer games, physical or mechanical processes overseen by trained dealers and monitored via video. RNGs and game outcomes are subject to independent testing and certification by accredited testing laboratories where required by our gaming license.

9.3 Certain games are supplied by third-party Business Partners under license; those providers are separately responsible for the fairness, functionality, and certification of their respective games, operating under their own regulatory approvals.

9.4 Prohibited Conduct in Gameplay. The use of bots, automated play software, card-counting devices (where applicable to live games), collusion between players, or exploitation of a known software bug, glitch, or defect to gain unfair advantage is strictly prohibited. We reserve the right to void any Winnings obtained through such means, recover previously withdrawn amounts, and close the associated Account(s).

9.5 Malfunctions and Disputed Results. In the event of a software malfunction, communication failure, disputed game result, or an obvious and demonstrable pricing or payout error, the record maintained on our servers (or those of the relevant game provider) shall be treated as the definitive record for resolving the dispute, and any payout inconsistent with the correct game rules or paytable may be void, adjusted, or corrected.

10. Prohibited Conduct

You agree that you will not: (a) access or use the Service where doing so would be unlawful in your jurisdiction; (b) use the Service for any fraudulent, unlawful purpose, or in furtherance of money laundering or terrorist financing; (c) attempt to manipulate, reverse-engineer, or interfere with any game, RNG, or the Site’s software, servers, or networks; (d) use another person’s identity, Account, or payment method, or permit another person to use your Account; (e) circumvent any geographic, self-exclusion, or access restriction we have applied (including via VPNs or proxy services); (f) engage in abusive, threatening, or harassing conduct toward our staff or other players; (g) use the Service to test, probe, or exploit vulnerabilities in our systems without authorization.

Violation of this section may result in immediate suspension or termination of your Account, forfeiture of Funds and Winnings, and, where appropriate, referral to law enforcement, regulators, or industry fraud-prevention databases.

11. Intellectual Property

All Content on the Site — including software, source code, graphics, logos, trademarks, game designs, audio, and text — is owned by, or licensed to, Jacked Up Games Ltd and is protected by applicable copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial entertainment purposes only, subject to this Agreement. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works from any part of the Service without our prior written consent.

12. Software and Mobile Applications

12.1 Where you access the Service via a downloadable client or mobile application, you are granted a limited, revocable, non-exclusive license to install and use that software solely to access the Service, subject to this Agreement and any additional terms presented at the point of download.

12.2 We may update, patch, or modify the software from time to time. Continued use of an outdated version may result in reduced functionality or loss of access, and we recommend keeping the application up to date.

12.3 You are responsible for ensuring your device and internet connection meet the technical requirements necessary to use the Service, and we are not liable for issues arising from incompatible or malfunctioning devices, networks, or third-party app stores.

13. Communications and Marketing

13.1 We may send you Account-related and transactional communications (e.g., verification requests, security alerts, responsible-gambling notices) necessary for the operation of the Service; these cannot be opted out of while your Account remains active.

13.2 We will only send you marketing communications regarding products, promotions, and services — including from our Business Partners — if you have opted in to receive them. You can withdraw this consent at any time via your Account settings or by contacting customer support.

14. Limitation of Liability

14.1 The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by applicable law, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

14.2 We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, and we are not liable for losses arising from technical failures, connectivity interruptions, cyberattacks, or events beyond our reasonable control.

14.3 To the fullest extent permitted by applicable law, Jacked Up Games Ltd, its directors, officers, employees, licensors, and Business Partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of, or inability to use, the Service.

14.4 Nothing in this Agreement excludes or limits liability that cannot lawfully be excluded or limited under the law applicable to you, including liability for death, personal injury, or fraud.

15. Indemnification

You agree to indemnify, defend, and hold harmless Jacked Up Games Ltd, its directors, officers, employees, agents, licensors, and Business Partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your breach of this Agreement; (b) your misuse of the Service; (c) your violation of any applicable law; or (d) your violation of any third-party right.

16. Suspension and Termination

16.1 We reserve the right to suspend or terminate your Account, at our discretion and with or without notice, where we reasonably believe you have breached this Agreement, engaged in fraudulent or suspicious activity, or where required by a regulator, law enforcement authority, or applicable law.

16.2 Upon suspension pending investigation, we may withhold pending withdrawals until the matter is resolved.

16.3 Upon termination, any verified balance properly belonging to you will be returned, subject to deduction of any amounts owed to us, any amounts subject to investigation, dispute, or regulatory hold, and any applicable fees.

16.4 You may close your Account voluntarily at any time by contacting customer support, subject to completion of any pending verification, responsible-gambling cooling-off period, or withdrawal process already in progress.

17. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under this Agreement where such failure or delay results from circumstances beyond our reasonable control, including natural disasters, acts of government, war, terrorism, civil unrest, internet or telecommunications failures, power outages, or cyberattacks.

18. Changes to These Terms

We may amend this Agreement from time to time to reflect changes in our practices, services, or applicable legal and regulatory requirements. The updated Terms will be posted on the Site with a revised effective date, and, where reasonably practicable, we will provide advance notice of material changes via email or an in-Service notice. Your continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms. If you do not agree with a change, your remedy is to stop using the Service and close your Account.

19. Third-Party Content, Links, and Business Partners

The Service may include games, payment options, or links provided by third-party Business Partners. We are not responsible for the content, accuracy, availability, or practices of these third parties, and your interactions with them (including any separate terms, licenses, or privacy practices they maintain) are solely between you and that third party.

20. Complaints and Dispute Resolution

20.1 If you have a complaint regarding the Service, please contact our customer support team in the first instance so that we may attempt to resolve the matter promptly and in good faith.

20.2 If a complaint cannot be resolved informally within a reasonable period, it will be handled in accordance with any formal complaints-handling or alternative dispute resolution (ADR) procedure required by our gaming license, including, where applicable, referral to an independent dispute-resolution body designated by our licensing authority.

20.3 Nothing in this section limits your right to pursue any remedy available to you under applicable law, including the right to file a complaint with a relevant regulatory authority.

21. Governing Law and Jurisdiction

This Agreement is governed by, and shall be construed in accordance with, the laws of Anjouan, without regard to conflict-of-law principles, without prejudice to any mandatory consumer-protection or other rights you may have under the law of your own jurisdiction of residence, which will continue to apply to the extent required by that law and cannot be excluded by contract.

22. Assignment

We may assign, transfer, or subcontract our rights and obligations under this Agreement, in whole or in part, to any affiliate or successor entity, including in connection with a merger, acquisition, or sale of assets, without your consent. You may not assign or transfer your rights or obligations under this Agreement without our prior written consent.

23. Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable under applicable law, that provision shall be severed, and the remaining provisions shall continue in full force and effect.

24. No Waiver

Our failure to enforce any right or provision of this Agreement shall not be deemed a waiver of that right or provision, nor of our right to enforce it at a later time.

25. Entire Agreement

This Agreement, together with our Privacy Policy, Responsible Gambling Policy, Cookie Policy, and any game- or promotion-specific rules, constitutes the entire agreement between you and Jacked Up Games Ltd regarding your use of the Service, and supersedes any prior agreements or understandings, whether written or oral.

26. Survival

Provisions of this Agreement that by their nature should survive termination of your Account — including but not limited to intellectual property, limitation of liability, indemnification, governing law, and dispute resolution — shall survive any termination or expiration of this Agreement.
